Amanda Knox Weapon to Be DNA Retested - The Daily Beast

23/01/11 01:40:38 BBC News - New tests for 'murder weapon' in Amanda Knox case

"The prosecution's case might have been defeated had the defense lawyers been more unified. After all, there was no solid confession, no real murder weapon [hence the forensic re-examination of the knife's DNA], no convincing motive and not much evidence." "Angel Face," Barbie Latza Nadeau, p.153. This case's investigation and trial are too much of a mess. Can justice ever be done here? Are there other factors and people?

There is a way to actually get the truth these days by reading the brain which has been in use for a decade at least but generally unacknowledged which most people do not want to believe exists preferring aliens instead, so it continues to be abused rather than used effectively.

However, if she suffered a drug induced blackout and frenzy of murder such as was fictionally portrayed in Donna Tartt's "The Secret History" set at a US liberal arts school, this would present a challenge. Nonetheless, there is the very real possibility that all is recorded in the brain under the level of consciousness provided the neurons are not destroyed sort of like memory chips. Almost all, if not all, of our memories are there, and whether they can be retrieved from the brain or not remains to be seen. This research currently using non-consenting human guinea pigs is kept secret at present.

The courts everywhere as a general rule are far behind technology although many years ago I read about legal proceedings in the US using related brain verification techniques in cases to prove innocence although I have not seen any of this lately. When the courts and the public catch up with today's science and the science that I have been experiencing for the past decade, we might move forward by being able to determine guilt or innocence on a more sound basis and put aside all this speculation and rhetoric.

But, legal justice systems have to move on the basis of reliability to ensure that the innocent are not punished while the guilty remain free. I've seen far too much where people carry out crimes and blame others for what has happened hoping to get away with it while generating a feeding frenzy that takes place against the innocent. There must always be due process, skill and expertise applied at every step of the way from investigation to judgement to ensure that the guilty are punished and the innocent are not. The public must always be properly protected. At present law enforcment and the judicial systems everywhere are wide open to abuse which takes place continuously from all sources.

"I am denying the defense request to have an independent analysis of all the DNA evidence." said Judge Massi during the trial going on to say "The decision is not an indicator of guilt." Barbie Latza Nadeau goes on to write "But in fact it was" (page 157 in her book "Angel Face"). So, now on appeal, there is an independent review by a "superperizia" [super analyst] which will take place and is why this article is all important.

Well said. Here are two examples from London which show just how these things can go wrong where there is no capital punishment so that justice eventually gets done even when it goes astray:

Rachel Nickell: murderd in Wimbledon Common 1992. There was no forensic evidence to connect Colin Stagg with her murder so the police used psychological profiling and a "honeytrap." The judge said at his trial that "the police had shown "excessive zeal" and had tried to incriminate a suspect by "deceptive conduct of the grossest kind". The entrapment evidence was excluded and the prosecution withdrew its case. Mr Stagg was acquitted in September 1994."

In 2006 the police charged Robert Napper with her murder. It was then revealed that because of police "bad decisions and errors" with respect to earlier crimes he had been left free to kill her and another women and her four-year-old daughter each of which could have been prevented. Jill Dando: murdered at her door step in 1999. Barry George was charged, tried and convicted. "[A]fter discredited forensics evidence was excluded from the prosecution's case, George's third appeal succeeded in November 2007. The original conviction was quashed and a second trial lasting eight weeks ended in George's acquittal on 1 August 2008." See http://bit.ly/ebdLUd Her murderer is still free.
